(p.12), esso è nato come tesi di laurea; si tratta quindi di un'opera redatta quando l'A. non aveva neanche ancora iniziato il percorso di dottorato di ricerca. Questo fatto può spiegare la presenza di numerose ingenuità, affermazioni avventate, ambigue o inesatte, nonché un'impostazione del lavoro che sarebbe eccessivamente ambiziosa anche per uno studioso con qualche anno di esperienza in più. Il libro infatti si propone (...) non solo di analizzare la legislazione giustinianea in tema di schiavitù, ma anche di individuare i profili nuovi che i passi degli antichi giuristi assumono tramite il loro inserimento nel Digesto; di accertare inoltre l'impatto dei testi legislativi nella realtà sociale, al fine di verificare “se siano effettivamente stati i fattori socio-economici la principale causa del declino a quest'epoca della schiavitù, al di là dell'evoluzione legislativa subita e dell'influenza esercitata dai princìpi cristiani” (p.11). Consider orthodox motivational judgment internalism: necessarily, A’s sincere moral judgment that he or she ought to φ motivates A to φ. Such principles fail because they cannot accommodate the amoralist, or one who renders moral judgments without any corresponding motivation. The orthodox alternative, externalism, posits only contingent relations between moral judgment and motivation. In response I first revive conceptual internalism by offering some modifications on the amoralist case to show that certain community-wide motivational failures are not conceptually possible. Second, I (...) introduce a theory of moral motivation that supplements the intuitive responses to different amoralist cases. According to moral judgment purposivism (MJP), in rough approximation, a purpose of moral judgments is to motivate corresponding behaviors such that a mental state without this purpose is not a moral judgment. MJP is consistent with conceptual desiderata, provides an illuminating analysis of amoralist cases, and offers a step forward in the internalist-externalist debates. (shrink)

We owe the problem of the speckled hen to Gilbert Ryle. It was suggested to A.J. Ayer by Ryle in connection with Ayer’s account of seeing. Suppose that you are standing before a speckled hen with your eyes trained on it. You are in good light and nothing is obstructing your view. You see the hen in a single glance. The hen has 47 speckles on its facing side, let us say, and the hen ap­ pears speckled to you. On (...) Ayer’s view, in seeing the hen, you directly see a speckled sense-datum or appearance. Ryle wondered how many speckles there are on the sense-datum. After all, intu­ itively, the hen does not appear to you to have 47 speckles. And if this is the case, then it does not present to you an appearance with 47 speckles. Equally, however, the hen does not appear to you not to have 47 speckles. So, it does not present an appearance that lacks 47 speckles either. (shrink)

The goal of this paper is to examine whether business performance is affected by the adoption of practices included under the term Corporate Social Responsibility (CSR). To achieve this goal, we analyse the relation between CSR and certain accounting indicators and examine whether there exist significant differences in performance indicators between European firms that have adopted CSR and others that have not. The effects of compliance with the requirements of CSR were determined on the basis of firms included in the (...) Dow Jones Sustainability Index (DJSI), and specific accounting indicators were applied to measure performance. For the purposes of this study, we selected one group of firms belonging to the DJSI and another comprised of firms quoted on the Dow Jones Global Index (DJGI) but not on the DJSI. The sample was made up of two groups of 55 firms, studied for the period 1998–2004. Empirical analysis supports the conclusion that differences in performance exist between firms that belong to the DJSI and to the DJGI and that these differences are related to CSR practices. We find that a short-term negative impact on performance is produced. (shrink)

Numerous studies indicate that racial minorities are both more likely to be executed for murder and that those who murder them are less likely to be executed than if they murder whites. Death penalty opponents have long attempted to use these studies to argue for a moratorium on capital punishment. Whatever the merits of such arguments, they overlook the fact that such discrimination alters the costs of murder; racial discrimination imposes higher costs on minorities for murdering through tougher sentences, and (...) it imposes lower costs on whites for murdering minorities by dispensing weaker sentences. These cost differentials constitute an injustice not simply to actual minority defendants in capital cases, nor simply to the actual minority victims of murder, but to all members of minority communities. I here offer two arguments for a moratorium on capital punishment: The first draws upon evidence of racial discrimination against minority defendants in capital cases, and claims that such discrimination modifies the costs of murder in such a way that minority individuals do not enjoy equal status under the law. The second draws upon the evidence regarding racial discrimination in relation to the race of victims, and claims that such discrimination modifies the costs of murder in such a way that minority individuals do not enjoy the equal protection of the law. Thus, by not assigning equal costs to murder, the American criminal justice system fails to provide racial minorities the equality under the law and discounts the value of their lives and liberties. A moratorium is the least unjust response to such a social injustice. I also reply to the criticism that a moratorium prevents us from executing deserving murderers. (shrink)

This paper builds on previous work by Sirgy, M. J., Journal of Business Ethics 19, 193–206, dealing with issues of code of conduct of marketing educators. Sirgy developed a discussion document outlining a semblance of what might be construed as a code of ethics for marketing educators. The discussion document was debated and accompanied by three commentaries. One conclusion derived from the discussion document and the commentaries is the need to develop a code of ethics involving behaviors that most marketing (...) educators find morally unacceptable. The current paper reports on a descriptive study involving a survey of marketing educators in which survey respondents were asked to rate the extent to which certain behaviors are deemed acceptable or unacceptable. The results of the survey identified certain behaviors deemed unacceptable by the vast majority of survey respondents. This evidence of hypernorms within the community of marketing educators was used to propose an initial code of ethics. (shrink)

This paper deals with the problem of verification of game-like structures by means of symbolic model checking. Alternating-time Temporal Epistemic Logic (ATEL) is used for expressing properties of multi-agent systems represented by alternating epistemic temporal systems as well as concurrent epistemic game structures. Unbounded model checking (a SAT based technique) is applied for the first time to verification of ATEL. An example is given to show an application of the technique.

As a first comment it should not be taken that we have any argument against the consistency of Mellor’s actualist version of the B-theory. Not only have we no argument; we hold that Mellor’s position is consistent. As far as logic goes we believe that you can translate A into B, and B into A. Mellor takes a quotation from our article as endorsing the policy of doing for time just what you do for modality, and vice versa, and it (...) is true that you can take our sentence that way. It is also true that we are sympathetic to an equal treatment of these two, but it is important to acknowledge that nothing in the logic forces you to do this. In particular, we agree with Mellor that practically no one treats space in an A-theory manner – even though it is logically consistent to do so. Our concern is solely with Mellor’s argument that a certain position in the temporal case is inconsistent where the analogous modal position is not. And our paper is addressed not so much to Mellor’s own position as to an A-theorist who wants to escape the consequences of Mellor’s argument by doing for time what Mellor does for modality. In fact, there is a position against which Mellor’s argument is successful. As far as we can tell the version we shall present is, if not precisely what Mellor has in mind, close to it, or at least sufficiently like it to illustrate his reply in a form in which we are able to comment on it. This essay addresses mineral water as a medical, experimental and economic material. It focuses on the career of the Reverend Dr William Laing , a physician and cleric who wrote two pamphlets about the water of provincial spa located in Peterhead, a town on the north-east coast of Scotland. I begin by outlining his education and I then reconstruct the medical theory that guided his efforts to identify tonics in the well’s water. Next, I explain why Laing and several other (...) local inhabitants thought themselves to be authorities on the palliative power of the water and I close by showing how such effects were commodified by local entrepreneurs. Although I concentrate primarily upon Peterhead Spa, this study touches upon several issues relevant to the types of medical theory and chemical experimentation that were being used in provincial Scotland during the late eighteenth and early nineteenth centuries. Andrzej Kisielewicz has proposed three systems of double extension set theory of which we have shown two to be inconsistent in an earlier paper. Kisielewicz presented an argument that the remaining system interprets ZF, which is defective: it actually shows that the surviving possibly consistent system of double extension set theory interprets ZF with Separation and Comprehension restricted to 0 formulas. We show that this system does interpret ZF, using an analysis of the structure of the ordinals.

The central Fodorian objections to Inferential Role Semantics can be taken to include an ‘Analyticity Challenge’ and a ‘Circularity Challenge’, which are ultimately challenges to IRS explanations of concept possession. In this paper I present inferential role theories, critically examine those two challenges and point out two misunderstandings to which the challenges are exposed. I then state in detail a rationalist version of IRS and argue that this version meets the Fodorian challenges head on. If sound, this line of argument (...) shows that there is no problem of principle in the consideration of IRS as a good candidate for a theory of concepts.Las objeciones fodorianas en contra de una Semántica del Papel Inferencial pueden concebirse como incluyendo un ‘Reto de la Analiticidad’ y un ‘Reto de la Circularidad’, los cuales son principalmente retos a las explicaciones que SPI proporciona sobre la posesión de conceptos. En este artículo presento las teorías del papel inferencial, examino críticamente estos retos y señalo dos malentendidos a los cuales están expuestos. A continuación, presento con detalle una versión racionalista de SPI y defiendo que esta versión supera los retos fodorianos directamente. This paper examines the work ethic characteristics of particular practising Protestant, Catholic and Muslim managers in Britain, Ireland and Turkey. Max Weber, argued that Protestant societies had a particular work ethic which was quite distinct from non-Protestant societies. The Protestant work ethics (PWE) thesis of Weber was reviewed. Previous empirical and analytical research results showed that the number of research results which support Weberian ideas were more than those which did not support. Methodological issues were also discussed. Results revealed that (...) there was a considerable difference between Muslim and other groups in terms of PWE characteristics. The Muslim group showed the highest PWE level, while the Protestant group was placed second and the Catholic group third. The Protestant group showed a slightly higher of PWE level than the Catholic group. The possible reasons for the higher level of the PWE values of Muslim managers are discussed in the light of historical, political, social and economic developments in Turkey. (shrink)

A unifying theory of general anesthetic-induced unconsciousness must explain the common mechanism through which various anesthetic agents produce unconsciousness. Functional-brain-imaging data obtained from 11 volunteers during general anesthesia showed specific suppression of regional thalamic and midbrain reticular formation activity across two different commonly used volatile agents. These findings are discussed in relation to findings from sleep neurophysiology and the implications of this work for consciousness research. It is hypothesized that the essential common neurophysiologic mechanism underlying anesthetic-induced unconsciousness is, as with (...) sleep-induced unconsciousness, a hyperpolarization block of thalamocortical neurons. A model of anesthetic-induced unconsciousness is introduced to explain how the plethora of effects anesthetics have on cellular functioning ultimately all converge on a single neuroanatomic/neurophysiologic system, thus providing for a unitary physiologic theory of narcosis related to consciousness. In the long 20th century, modern China experienced perhaps the world’s most radical and systematic secularization process and the decimation of traditional religious and ritual cultures. This article seeks to account for this experience by engaging with postcolonial theory, a body of discourse seldom found relevant to China Studies. The article attempts a two-pronged critique of both state secularization and some aspects of existing Postcolonial Studies/theory. It shows the many ways in which nationalist elites in modern China unwittingly absorbed Western (...) Orientalist discourse even as their words and actions were ostensibly anti-colonial, and much of the article examines the consequences of this native Orientalism upon Chinese religiosities. Finally, the article suggests that one cannot discuss governmentality in modern China without understanding how it is intertwined with a sovereign power that is both archaic and, at the same time, has experienced renewal and expansion in modernity. Many intellectuals wrote texts on the relations between Islam and science in the nineteenth‐century Ottoman Empire. These texts not only addressed the massive social and cultural changes the Empire was going through, but responded to European authors’ claims about the extent to which Islam was compatible with the modern world. Focusing on several texts written in the second half of the nineteenth century by the influential Muslim Ottoman authors Namik Kemal, Ahmed Midhat, and Şemseddin Sami, this article shows the influence (...) of these exigencies on arguments on Islam and science. In order to represent Islam as a respectable religion in harmony with science, these intellectuals defined a “pure Islam” that was a set of basic principles that could be found in the Qur'an. Rather than an embedded way of life, Islam in these texts was an objectified, delimitable entity that could be imagined as having relations with other entities, such as science. (shrink)

This paper concerns a puzzle about the logical form of expressions involving repeated `and's. Obvious attempts to solve the problem fail. It happens that a proper solution surprisingly requires the semantic notions of sampling and expression. I speculate that this may provide an alternative to conversational implicature.

In nursing, expectations of honesty and integrity are clearly stipulated throughout professional standards and codes of conduct, thus the concept of academic integrity has even more impetus in preparing students for graduate practice. However, a disparity between policy and practice misses the opportunity to instil the principles of academic integrity, and at its core honesty, a pivotal trait in the nursing profession. This study draws upon the experience of the nursing faculty to explore how academic integrity policy of deterrence operate (...) in nursing education.While participants deplored cheating behaviours, they expressed frustration in having to ‘police’ large numbers of students who had little awareness of the academic standards to meet policy requirements. In addition, they were cynical because of a perceived lack of severity in sanctions for students who repeatedly breached integrity. Participants expressed a moral obligation as educators to meet student learning needs and preferred to engage with students in a more meaningful way to uphold academic integrity. The ambivalence to detect and report breaches in integrity undermines the effectiveness of policy. Therefore, faculty must recognise the importance of their role in detecting and escalating cases of dishonesty and execute deterrence in a more consistent way. To do this, greater support at an institutional level, such as smaller class sizes, inclusion in decision making around sanctions and recognition of additional workload, will enable faculty to uphold policy. Although policing was not their preferred approach, the role of faculty in detecting and reporting cases of misconduct is crucial to increase the certainty of students getting caught, which is essential if policy is to be effective in deterring dishonest behaviour.
